In 2002 the Victorian Government enacted Security of Payment legislation aimed at providing building industry contractors, subcontractors and suppliers with a means of obtaining quick, cheap and easy payment for work or supplies provided to head contractors or principals under building or related industry contracts.

The legislation was substantially revamped in 2006 for contracts entered into on or after 1 March 2007. The legislation created a process called 'Adjudication' under which certain organisations ('ANA's') were authorised by the Victorian Building Commission to nominate Adjudicators to make decisions in respect of outstanding payment claims made by participants in the Victorian building industry.

Adjudication is a process that:

  • provides for an Adjudicator to make a decision on an outstanding payment claim within 10 business days
  • is a far cheaper and much faster alternative to suing for payment in a Court
  • is an informal process and in many cases can be undertaken without lawyers

BAV has been authorised by the Building Commission to nominate Adjudicators to make decisions on payment claims. This website has been prepared by BAV to provide you with the information you need to participate in the adjudication process and it contains sample forms prepared by the Building Commission for your guidance.
